Our experience in fraud management and prevention, as well as compliance, is also highly valued by the banking sector.
Consequently, eight Belgian banks have asked us, together with the independent fraud audit firm I-Force, to provide a 10-day training course on fraud management and prevention.
During this course, which runs from January to April 2019, we help the banks to better equip themselves in the fight against both internal and external bank fraud.
Some of the hot topics covered include: the status of the private fraud investigator, privacy legislation and the compatibility of fraud investigations with the GDPR Regulation.
In addition, we analyse the various investigative methods and measures that banks use in their fight against fraud from a legal perspective, examining in each case how banks can best integrate these into their operations.
More specifically, we focus on the following concrete questions:
- how does the right to privacy of a bank employee or customer relate to the possibilities of investigating fraud?
- can the fraud investigator review a bank employee’s emails to ensure that no fraud has been committed?
- what guarantees should a fraud investigator provide to a person they are interviewing?
- may a fraud investigator access the bank account of a customer or employee?
- can the banker freeze the account when fraud is detected?
- how can the bank’s fraud department best incorporate the GDPR into its operations?
Finally, we consider the possibility of encapsulating the bank’s fraud policy within a fraud policy, as this offers the best opportunities to conduct a fraud investigation transparently, whilst respecting the privacy of the customer or bank employee, without being reprimanded by a court afterwards.
A fascinating and topical theme, where the necessary preparation offers more possibilities than one might initially think.
